In Burrell v Clifford [2016] EWHC 578 (Ch) the trial judge, Richard Spearman QC (sitting as a Deputy Judge of the High Court) considered the issue of costs and, in particular, the significance of “without prejudice, save as to costs” offers made outside of the Part 36 regime and the proportionately of costs to damages.
